A Bodman Workplace Law Group Alert: Michigan's 'No Texting While Driving' Law Takes Effect
7/2/2010On July 1, 2010, Michigan's "No Texting While Driving Law" goes into effect. With the exception of emergencies, the law generally prohibits reading, manually typing, or sending text messages on a "wireless 2-way communication device" that is located in a driver's lap or hand. The new law does not prohibit the use of GPS devices affixed to a motor vehicle and does not specifically prohibit the use of a cell phone to make or receive phone calls. Drivers should be careful, however, as they may be accused of "texting" while inputting phone numbers or web addresses into their cell phones. Violators of the new law face a $100 fine for a first offense and a $200 fine for each subsequent offense.
Employers should update their policies to reflect the change in the law. This new policy may be helpful in reducing or limiting claims that the employer is negligent by allowing employees to text while driving or not advising the employees on the new law.
